The workshop on “Obstacles and facilitating factors towards the digitalisation of Justice: the specific issue of electronic evidence in criminal trials” was held in Rome at the Casa dell’Aviatore on 10 and 11 of December 2015, in the framework of EVIDENCE Project . The discussion was focused, among other things, on a map of 40 obstacles and 21 facilitating factors for the collection, preservation and exchange of electronic evidence in courts (mainly referring to electronic evidence in criminal procedures), drafted by LSC. These obstacles and facilitating factors are of an organisational, cultural or regulatory nature and risk to jeopardise the implementation of any decision at legal or technical level in this field. They may be either operational in nature (linked to rules, powers, resources, organisational factors, etc.) or cognitive (i.e. linked to ideas, attitudes, culture, representations of reality). The workshop was attended by 36 people, representing organizations based in eight European countries (Austria, Bulgaria, Germany, Italy, Malta, the Netherlands, Spain, the United Kingdom) and some international bodies. Some strategic suggestions were formulated within the framework of the Road Map that EVIDENCE is preparing for a systematic, aligned and uniform application of new technologies in the collection, use and exchange of evidence.
