EVIDENCE – EUROPEAN INFORMATICS DATA EXCHANGE FRAMEWORK FOR COURT AND EVIDENCE


LSC is a partners of the consortium EVIDENCE (Funding Scheme: CSA - Supporting Action, Call ID FP7-SEC-2013-1; Grant Agreement No: 608185). EVIDENCE is co-ordinated by the Italian National Research Council and its duration is 30 months (March 2014 - August 2016).

The EVIDENCE Objectives are to:
• Carry out a classification of relevant concepts of electronic evidence domain and related fields (criminal law, criminal procedure);
• Assess and understand whether and how electronic evidence is perceived and eventually regulated in the EU framework
• Identify the definition of open standards, assuring not only the international transfer of evidence but also the chain-of-custody requirements and the protection of the means of proof;
• Provide an overview and a status quo assessment of the collection, preservation and exchange of evidence obtained using new technologies (‘electronic evidence’) from the standpoint of law enforcement, and propose guidelines that could be integrated into a Common European Framework governing this field;
• Review the legal, ethical and societal implications of the desired options;
• Test the selected approaches through a combination of real life case studies and involving end users, including INTERPOL’s Digital Crime Centre and national judicial and law enforcement authorities;
• Detect societal dynamics including the “market” for EVIDENCE solutions;
• Create a Road Map and guidelines that would enable the setup of a Common European Framework for the regulation and standardization of electronic evidence gathering and Exchange.

Partners of EVIDENCE are: National Research Council (IT), Co-ordinator; University of Groningen (NL); The International Criminal Police Organization (INTERPOL); Leibniz Universität Hannover (GE); Laboratory of Citizenship Sciences (IT); University of Malta (MT); Council of Bars and Law Societies of Europe (BE); Law and Internet Foundation (BG); Centre of Excellence in Information and Communication Technologies (BE).

LSC is the leader of work package 7 (“Market size”) devoted to an analysis of actors in this field and of the main obstacles and facilitating factors to the introduction of electronic evidence in courts, manly in criminal trials.
